Man Pleads to 45 years for Murdering his Roommate

MONTGOMERY COUNTY, TX -- On Thursday, October 27, 2022, Brian Guerrero, 30, plead guilty to the murder of his roommate in the 435th District Court, the Honorable Judge Patty Maginnis presiding. Per his agreement, Judge Maginnis sentenced Guerrero to 45 years in prison.

In November 2020, the Montgomery County Sheriff's Office received reports about the welfare of Mr. Timothy Dacy. A deputy traveled to Mr. Dacy's trailer to check on him. Once the deputy arrived, it was clear that a violent act had occurred. A crime scene unit and detectives from the Sheriff's office arrived on the scene and entered the home. Upon entering the trailer, they found Mr. Dacy's remains. Based on the evidence found at the scene and subsequent investigation, detectives learned that someone had stabbed Mr. Dacy over 70 times and that the murder had occurred some days before. Mr. Dacy was 28 at the time of his death. While law enforcement officers were still processing the scene, Guerrero drove up in Mr. Dacy's car.

Detectives interviewed Guerrero and learned he and Mr. Dacy were long-time friends and roommates. As they interviewed Guerrero, detectives noted the distinctive odor of human remains coming from Guerrero's clothes, indicating proximity to the remains. Detectives learned from Guerrero that he had pawned several of Mr. Dacy's things after Mr. Dacy's murder. Detectives subsequently found pawn receipts in Brian Guerrero's name for several guitars that had belonged to Mr. Dacy.

As the investigation progressed, Detectives learned that Guerrero had told friends that he had killed Mr. Dacy and had complained to them about the odor of the body in the trailer. Friends also reported that Guerrero had begun exhibiting concerning behavior, such as praying to Satan and attempting to get others to do the same.

Ultimately, Guerrero agreed to plead guilty rather than take his case to trial. Assistant District

Attorney Adam McLane: 'Mr. Dacy, a talented musician, was a faithful, kind friend to the defendant. He helped the defendant and gave him a place to live. In return, his roommate savagely and senselessly murdered him. Our hope for Timothy Dacy's family is that this measure of justice will bring them some consolation for the loss of their loved one.'
